UPDATE: Man Pushed Onto Midtown Q-Train Tracks Dies

A man, allegedly in his 60’s, was pronounced dead at St. Lukes-Roosevelt Hospital Center, earlier today around 12:30pm, after being pushed onto the midtown Q train tracks. Based on what witnesses told DNAinfo, the man could have been pushed after getting into a scuffle with two other men on the platform at the 49 Street station.

One of those witnesses, Patrick Gomez, 37, says, “You heard almost like a thud [then] you heard people yelling, people running out…people were just standing in shock.”

The name of the man has not yet been released and police are still searching for the person who pushed him.

UPDATE: The man pushed in an incident yesterday is named, Ki Suk Han, 58, from Elmhurst, Queens.  And police now have a photo of the man they believe push Han onto the train tracks of on oncoming train in midtown manhattan.

The man in the picture was caught on surveillance footage and some other morally questionable pictures captured by witnesses. The suspect apparently got into an argument with Han, who some say might have been drunk and aggressive, when Han tried to calm the man, who had been yelling on the platform, down.

A police source tells the NY Daily News, after Han got pushed onto the tracks, “He get’s back on his feet..he’s waving to the train, ‘stop!, stop!’ He tried to climb onto the platform and the train hits him” 

The search is currently on for the suspect.

Woman Sues Doctor Over Positive HIV Result

A 31-year-old Harlem woman is suing a Sheepshead Bay doctor because he told her she was HIV positive. According to reports, the woman, who went to Dr. Pavel Yutsis after her gastric bypass surgery nutritionist noticed her B12 and white blood cell levels were low, claims the doctor tested her with out her permission.

In New York state, health law requires a patient give written permission before an HIV test is conducted. The woman, who filed the lawsuit under the name “Jane Doe” (natch), tells DNAInfo, “I was tricked. I never signed any paper.”

The lawsuit says that Yutsis asked her to take the test and she declined because she wanted to concentrate on healing from the weight loss surgery. An assistant later asked to draw blood which was secretly tested. Upon a later visit, Yutsis revealed the results, telling Jane Doe she was positive for the virus.

Jane Doe’s lawyer, citing the state’s law, says there was also no further counselling provided and her results weren’t kept private.

Even though the outcome of the results will ultimately help her health,  the woman feels her right to choose was violated but says, “I’m working on things, I’m slim and trim and sexy.” (Priorities people, priorities)

Skate Park Near Completion in Canarsie Park


I was definitely unaware of the fact that NYC Parks and Recreation had any intentions to build a Skate Park, or rather Skate section, within Canarsie Park. This happy surprise has apparently been underway for over 3 years according to The New York Post.
According to the Canarsie Courier  the Skate Park is “projected to be completed by next May or June. The skating facility will be located at the western end of the park, adjacent to the cricket fields.” 
All these renovations are said to be a part of the “modernization” of Canarsie Park which previously only had a baseball field, cricket field, basketball court and a jungle gym.

The Canarsie Courier reports: 

The new plaza-style skate park will have a small bowl, ramps, and rails to accommodate skateboarding along with a surrounding path. The construction is state of the art – using the most current methods instead of outdated quarterpipes.The total cost of the project will be $2,308,000, with funds provided by Councilman Lew Fidler, Borough President Marty Markowitz, and Mayor Mike Bloomberg.
The cost is broken down as follows: Fidler ($1,600,000), Markowitz ($423,000), and Bloomberg ($285,000).
Fidler approached the Parks Department back in January 2002 with plans to refurbish the 132-acre park, which is the second largest in Brooklyn. Parks Department officials met with community activists over the past few years to discuss construction updates and take suggestions to improve the park.
Phase One included a new cricket field and cost $6.5 million to complete. The field was opened in June 2009, just in time for the Mayor’s Cup Cricket Tournament finals.
Other improvements included new paths, a forest area, ponds, a new landscaping and woodchip paths, bleachers, steel fencing perimeters, drinking fountains, a picnic grove, benches, new lighting, and new entrances along Seaview Avenue.
Phase Two, which began in the fall of 2009, included construction of pathways, a 

fitness trail with exercise stations, new park lighting, bicycle racks, benches, and steel fencing. New landscaping included lawn areas, shrubs and new trees.
Through Fidler’s efforts, the second phase was funded with $3.6 million, with an additional $115,000 allocated by Bloomberg.
United Canarsie South Civic Association (UCSCA) members and Vice President Lenny Fogel were instrumental in working with Fidler to push the project along.
Weather permitting, Canarsie’s youths — adults too — will be able to enjoy a safe place to skateboard, rather than skating in the middle of the street.


What does 2014 have in store for Public Schools?

Many of us were aware of a law that was passed over a decade ago when Bush was POTUS called No Child Left Behind (NCLB). It was an effort taken by the Federal Government to get involved with the education system country-wide in hopes of helping students pass their proficiency exams i.e. regents exams by 2014(+). Essentially, the government provided funding to schools and left the changes up to the them. The law has a way to determine the progress of each school through what they call the AYP or Adequate Yearly Progress. The AYP is their projection of students moving on each school should achieve as the years go by leading up to 2014. The law also defines ways in which a school can improve the academic standing of its students in order to meet the coming year’s AYP(+). Sounds like a good plan on the surface, however there’s a few main issues with this law.

(-)# 1: The goal of getting students to pass by 2014 applies to all students in the school. Meaning they’re looking for 100% pass rate, which is completely impractical.

(-)# 2: If a school fails to meet the AYP requirements, they have to take “corrective measures” each year going from 1-5 years. If each consecutive year the school fails to meet the standard, there are more severe measures the school is expected to implement . Granted, sometimes better can come from cleaning house, but at the same time its not always the school’s administrators, faculty, or leadership that the problem resides in. The students and parents are also part of the problem.

(-)# 3: The APY goes up yearly as we get closer to 2014. If we can’t get an adequate pass rate, then how can implementing certain changes account for all the varying issues to come up during the school year, as well as turn those troubled students around? It can’t. Unless of course the changes are effective (they aren’t).

(-)# 4: Lets take our attention to the chart titled “School Improvement Options” at the bottom of the provided link. Peep year 4. It says “During the first year of restructuring, the LEA (Local Education Authority) is required to prepare a plan and make necessary arrangements to carry out one of the following options:

(1)Reopen school as charter school.

(2)Replace principal and staff.

(3)Contract for private management company of demonstrated effectiveness.

(4)State takeover.

(5)Any other major restructuring of school governance.”

After looking at that you finally understand why these charter schools are popping up all over. If you don’t know what a charter school is , its pretty much (in North America) A publicly funded independent school established by teachers, parents, or community groups under the terms of a charter with a local or national authority. Sounds good right? Not really. The charter schools that are going to pop up all over are going to become private corporations which means education will become a multi-million if not billion dollar business just like prisons are today. All schools will suffer this fate after the 2014 evaluations. Unless a school can somehow accomplish the 100% pass rate of course (highly unlikely).

Now more than ever is it more important for students to become more self motivated and see whats at risk here. Whether they realize it or not they are our future and life is going to require more from them than some mundane behaviors and DILIGAF facial expressions. They are going to have to strive and work hard. Those of us that moved on from public school know that now is not the time to be playing around, and that those values are fundamental for an individual’s success in the coming years. I don’t know what the solution is for effectively educating the next generation, but if there aren’t any things done to correct this and prevent further decline, this one issue will impact us like a golf ball. Hitting one a few degrees off target will mean the difference between a hole in 1 and somewhere nasty and too cumbersome to correct immediately. Of course we can always ignore it and bank on the Mayan’s being right about 2012 and all that…

The Nets recently played their last game in New Jersey, giving them more time to focus on their exciting Brooklyn move. How befitting of Jay-Z, partial owner of the team, to reveal the new (possible) Brooklyn Nets Logo that has been speculated in multiple images these past few days.
